What to ExpectTesla is looking for an experienced litigation attorney and eDiscovery specialist to join the IP Litigation team within our fast-paced Legal Department. The Sr. Counsel will oversee all eDiscovery in connection with Tesla’s IP-related litigation matters, including patent, trade secret, and trademark cases. Just like some law firms act as national discovery counsel to certain of their clients, you will be national discovery counsel to Tesla as we defend litigation and promote Tesla’s mission of accelerating the world’s transition to sustainable energy and zero-emission transportation.What You’ll DoRepresent Tesla in all aspects of IP-related litigation matters, particularly relating to discoveryConsult on and engage in eDiscovery meet and confers regarding search terms, metadata, use and parameters for predictive coding, etc.Consult on and/or prepare responses to Discovery, Protective Orders, all front-end discovery-related stipulations, and motions to compelOversee all aspects of document review including application of carefully curated coding panels on voluminous document collections Identify and select documents and data critical to Tesla’s IP litigations, including for purposes of discovery compliance, case analysis, depositions, mediations, arbitrations, and trial preparationKeep abreast of case law, federal, state and local rules, and other statutory developments impacting discovery, ESI, etc.Possess a thorough understanding of: ESI Protocols, Production Orders, Protective Orders, and all front-end discovery-related stipulations What You’ll BringJD Degree from an ABA accredited law school and a member of a state bar6-10 years of experience actively litigating matters and managing intensive eDiscovery projects, including initial case assessment, strategy development, responding to discovery, overseeing all aspects of eDiscovery, and conducting witness interviews for case-specific document collections.. Less years of experience will be considered for the right, enthusiastic candidate with stellar eDiscovery intellectPreferably, IP litigation experience, specifically relating to the automotive/transportation and/or energy sectors.Ability to exercise business and legal judgment with strong problem-solving, research, and project management skills and ability to work closely with business (engineers and other non-lawyers)Clear and concise communication style, both in writing and verballyA quick and flexible learner: intellectually curious, open-minded, adaptable, comfortable with ambiguity and risk, and excited by dynamic changeInspire trust, forge relationships quickly, and earn the confidence and cooperation of your business partners
